Many abused women from patriarchal collectivistic societies that are subjected to social control seek help in community health clinics. The article is based on a qualitative study, which consisted of 24 interviews with 12 abused Israeli Arab women who sought the help of social workers in community health clinics. A central theme that emerged from the interviews was the women’s wish to maintain their self-determination in retaining the power to determine the boundaries of the intervention within the professional relationship. Apologie dans le sens de Socrate : sommé de répondre aux accusations des hommes de la cité, Mendelssohn, le " Socrate de Berlin ", doit répondre de soi. Peut-on être juif et éclairé à la fois? Le juif des Lumières est-il pensable? Peut-il exister? Face à la critique moderne du judaïsme - celle qui trouve sa formulation la plus accomplie dans le Traité théologico-politique de Spinoza -, Mendelssohn formule une (...) réponse fondamentale, inaugurant ainsi la pensée juive moderne. While the immediate aim of Walter Benjamin’s famous essay, “Critique of Violence,” is to provide a critique of legal violence, commentators typically interpret it as providing a further critique of state violence. However, this interpretation often receives no further argument, and it remains unclear whether Benjamin’s essay may prove analytically relevant for a critique of state violence today. This paper argues that the “Critique” proves thusly relevant, but only on condition that it is developed in two directions. The (...) first direction is conceptual, and consists in an explanation of the necessary relationship between states and violence. This explanation is found by appealing to a concept not cited in Benjamin’s text, but which, I argue, remains its implicit basis: sovereignty. According to this conceptual development, state violence is the necessary result of the state's attempt to maintain its sovereign law at the expense of emancipatory struggles to generate non-sovereign law. The second direction is genealogical, and consists in destabilizing the modern belief that justice is best served through the judicial channels of a sovereign state. Here I employ Michel Foucault’s genealogical research to demonstrate the historical contingency of state justice and, by extension, the possibility of a justice beyond the state. (shrink)

In this incisive new work, Eli Friedlander demonstrates that Walter Benjamin's entire corpus, from early to late, comprises a rigorous and sustained philosophical questioning of how human beings belong to nature. Across seemingly heterogeneous writings, Friedlander argues, Benjamin consistently explores what the natural in the human comes to, that is, how nature is transformed, actualized, redeemed, and overcome in human existence. I place Benjamin’s account of Blossfeldt’s achievement both in relation to Goethe’s studies of the vegetal realm as well as to the fantasy world of Grandville’s Animated Flowers. This juxtaposition allows me to interpret Benjamin’s understanding of the possibilities opened by photography and the transformation it brings to the relation of art to science and the (...) imagination. Volume XXIX of Studies in Contemporary Jewry takes its title from a joke by Groucho Marx: "I don't want to belong to any club that will accept me as a member." The line encapsulates one of the most important characteristics of Jewish humor: the desire to buffer oneself from potentially unsafe or awkward situations, and thus to achieve social and emotional freedom. By studying the history and development of Jewish humor, the essays in this volume not only provide nuanced accounts (...) of how Jewish humor can be described but also make a case for the importance of humor in studying any culture. A recent survey showed that about four in ten American Jews felt that "having a good sense of humor" was "an essential part of what being Jewish means to them," on a par with or exceeding caring for Israel, observing Jewish law, and eating traditional foods. As these essays show, Jewish humor has served many functions as a form of "insider" speech. It has been used to ridicule; to unite people in the face of their enemies; to challenge authority; to deride politics and politicians; in America, to ridicule conspicuous consumption; in Israel, to contrast expectations of political normalcy and bitter reality. However, much of contemporary Jewish humor is designed not only or even primarily as insider speech. Rather, it rewards all those who get the punch line. A Club of Their Own moves beyond general theorizing about the nature of Jewish humor by serving a smorgasbord of finely grained, historically situated, and contextualized interdisciplinary studies of humor and its consumption in Jewish life in the modern world. Elected politicians—legislators and, in some systems, members of the executive—can choose to exercise authority themselves or to delegate that authority to any number of agencies. Such delegation of power can occur at the constitutional stage, but is most common at the post-constitutional stage. Two categories of delegation can be distinguished: domestic delegation to agencies within the legislators’ jurisdiction, and international delegation to supranational or international bodies. While some research has been done on domestic delegation, especially in the context of delegation (...) to administrative agencies in the U.S., as well as on delegation to supranational bodies, especially with regard to the E.U., these activities have not been analyzed within a unified framework. This paper attempts to inquire into these issues and provide a general picture of the decision-making process regarding whether to delegate authority and to which body to transfer the authority. The past decade has been a period of rapid change in Central and Eastern Europe. Almost all of these countries have either passed entirely new constitutions or substantially modified the old ones. This is a unique situation in which constitutional delegation of powers can be performed almost simultaneously with post-constitutional delegation. The constitutional process in Israel is very different. It has been underway for fifty years. However, it can also be characterized by simultaneous constitutional and post-constitutional choices. In this paper, we examine such delegation choices in nine countries. We describe the main differences among these countries with regard to delegation of power, try to trace their origins and analyze their effects on delegation of powers. One question raised is what are the ramifications of a quasi-simultaneous constitutional and post-constitutional choice? Have constitutional rules been chosen in anticipation of the necessary compatibility with the rules of international organizations that one wants to join? Has membership in international organizations led to a boost in credibility of those governments concerned? (shrink)

Franz Rosenzweig is widely regarded today as one of the most original and intellectually challenging figures within the so-called renaissance of German-Jewish thought in the Weimar period. The architect of a unique kind of existential theology, and an important influence upon such philosophers as Walter Benjamin, Martin Buber, Leo Strauss, and Emmanuel Levinas, Rosenzweig is remembered chiefly as a "Jewish thinker," often to the neglect of his broader philosophical concerns. Cutting across the artificial divide that the traumatic memory of (...) National Socialism has drawn between German and Jewish philosophy, this book seeks to restore Rosenzweig's thought to the German philosophical horizon in which it first took shape. It is the first English-language study to explore Rosenzweig's enduring debt to Hegel's political theory, neo-Kantianism, and life-philosophy; the book also provides a new, systematic reading of Rosenzweig's major work, _The Star of Redemption._ Most of all, the book sets out to explore a surprising but deep affinity between Rosenzweig’s thought and that of his contemporary, the German philosopher Martin Heidegger. Resisting both apologetics and condemnation, Gordon suggests that Heidegger’s engagement with Nazism should not obscure the profound and intellectually compelling bond in the once-shared tradition of modern German and Jewish thought. A remarkably lucid discussion of two notably difficult thinkers, this book represents an eloquent attempt to bridge the forced distinction between modern Jewish thought and the history of modern German philosophy—and to show that such a distinction cannot be sustained without doing violence to both. Previous research (e.g., Horiuchi, Goldsmith, and Inoguchi, 2005) has shown some intriguing patterns of effects of several variables on international public opinion about US foreign policy. But results for the theoretically appealing effects of regime type and post-materialist values have been weak or inconsistent. This paper takes a closer look at the relationship between these two variables and international public opinion about US foreign policy. In particular, international reaction to the wars in Afghanistan (2001) and Iraq (2003) are examined using (...) two major multinational surveys. The conclusions of previous research are largely reinforced: neither regime type nor post-materialist values appears to robustly influence global opinion on these events. Rather, some central interests, including levels of trade with the US and NATO membership, and key socialized factors, including a Muslim population, experience with terrorism, and the exceptional experiences of two states (Israel, Albania) emerge as the most important factors in the models. There is also a consistent backlash effect of security cooperation with the US outside of NATO. A discussion of these preliminary results points to their theoretical implications and their significance for further investigation into the transnational dynamics of public opinion and foreign policy. Public procurement provides an excellent window into the shaping of corporate social responsibility of companies contracted by the government. To this emerging scholarly realization, we want to add that public procurement provides also the opportunity to examine corporate social responsibility as practiced by public sector organizations. This opportunity enables the investigation of the conditions under which public sector organizations endorse CSR guidelines, adherence to which demonstrates accountability for their service providers’ legal, employment-related practices. Our study examined the possibility that public (...) sector organizations’ CSR is enhanced by maintenance managers’ role dissonance emerging in response to an ethical mismatch between them and their organizations’ official stance concerning whether unethical employment practices of service providers should be sanctioned. We analyzed interviews with 13 managers in charge of contract administration in the area of cleaning and maintenance. Our findings suggest that the role dissonance that emerges in cases of mismatch in ethical orientation rarely enhances more responsible treatment of cleaning employees. We introduce a model indicating the conditions supporting this incident. (shrink)

Modern Jewish philosophy emerged in the seventeenth century, with the impact of the new science and modern philosophy on thinkers who were reflecting upon the nature of Judaism and Jewish life. This collection of new essays examines the work of several of the most important of these figures, from the seventeenth to the late-twentieth centuries, and addresses themes central to the tradition of modern Jewish philosophy: language and revelation, autonomy and authority, the problem of evil, messianism, the influence of Kant, (...) and feminism. Sullo sfondo della questione del rapporto tra passato, memoria e identità, che in entrambi assume una forma drammatica, tale confronto riguarda in particolare l’opera di Kiefer, Der Engel der Geschichte. Mohn und Gedächtnis (L’Angelo della storia: papavero e memoria; piombo, vetro, fili metallici e papaveri, 1989, The Israel Museum, Jerusalem) e l’Angelus Novus di PaulKlee, al centro delle Tesi sul concetto di storia, (...) vero e proprio testamento filosofico di Benjamin. Il confronto tra l’arte di Kiefer e la filosofia di Benjamin si sviluppa sul filo del contrappunto anziché della consonanza. Il tentativo è quello di mostrare come opera d’arte e testo filosofico possono dialogare, in quanto espressione di posizioni e linguaggi differenti e autonomi. Taking as his point of departure the vigilante killing of abortion doctor George Tiller in Wichita, Kansas, in 2009, he argues not only that abortion is always morally impermissible but so also is [End Page 217] the murder of abortion doctors and the use of the death penalty to punish those who murder them. In addition, he turns to the early church fathers to contend that, prior to Constantine, “without exception, the church strongly condemned the taking of human life in any form whatsoever”—thus rejecting abortion and infanticide, the blood sport of the Roman games, suicide, and killing in war (120). This was because the New Testament witness to Jesus and his death on the cross required early Christians to view “the means as just as important, if not more important, than the ends” (xiii).Arner supplements this deontological argument for Christian pacifism, which he learned from John Howard Yoder, with a brief consideration of the virtue of patience cultivated in the early churches, reflecting the influence of Stanley Hauerwas on his thought. This “cardinal virtue” connoting “longsuffering, forbearance, patient endurance”—as found in Jesus’s teaching in the Sermon on the Mount (Mt 5:38–48)—enabled early Christians to practice non-violent resistance “deferring personal revenge in favor of God’s vindicating justice” (98). If Christians were to adopt this same consistently pro-life ethic today, argues Arner, it would “lead to greater healing and peace in our blood-soaked world” (121). The book closes with three appendices—one of which is a chart of terminology that dehumanizes vulnerable victims, including unborn human beings. Unfortunately, the book does not have an index.Christ at the Checkpoint, edited by Paul Alexander (professor of Christian ethics and public policy at the Palmer Theological Seminary of Eastern University), includes thirteen plenary addresses delivered at a conference on the Arab-Israeli conflict organized by Palestinian Evangelical Christians at Bethlehem Bible College in March 2010. Almost all of the contributors to this volume—including biblical scholars, theologians, ethicists, pastors, activists, and others—criticize the ideology of Christian Zionism and its support of a theology of dispensationalism that, in their view, distorts the scriptures and fosters violence rather than reconciliation between the Israelis and the Palestinians. In his own presentation titled “What Can Pentecostals and Charismatics Do for Peace with Justice in Israel and Palestine?,” Alexander—who describes himself as a former “one-sided” Christian Zionist who later discovered the writings of Yoder and Hauerwas—appeals to Jesus’s teaching in the Sermon on the Mount and urges Pentecostals to create church communities “that cultivate persons of character and conviction, who through habits, practices, and action live out the core of our faith” (69). HuffAlmost a year after Hurricanes Katrina and Rita devastated his beloved New Orleans, Benjamin Wren, longtime member of the history department at Loyola University–New Orleans, died on July 20, 2006. Wren joined the Loyola faculty in 1970 and taught popular courses in Chinese history, Japanese history, and world history. He is best remembered for his unprecedented courses in Zen and the (...) unique campus zendo where he taught them. His courses integrated meditation practice, philosophical reflection, historical investigation, and a bit of group therapy into what many students have described as life-changing experiences.Wren was the son of an American Marine and a Hong Kong native who met in Tientsin, China. Growing up in the American South during the Great Depression and World War II, he encountered firsthand the racism and xenophobia that defined the Bible Belt as a distinct cultural region in the first half of the twentieth century. He entered the Society of Jesus when he was seventeen years of age and earned degrees from Spring Hill College, Saint Louis University, and the University of Arizona. Nearly fifty years later, he left the Jesuits and married Patricia Wren.Wren's professional life did not follow the path of the conventional academic career. For several years he taught in Jesuit high schools. After discovering a book on the Japanese art of flower arranging in a Texas public library, he pursued graduate studies in Asian religion and history. Like many of his generation, he was influenced by Jean Dechanet's Christian Yoga and Dom Aelred Graham's Zen Catholicism. He studied Zen with Yamada Roshi in Kamakura and ikebana with Sofu Teshigahara of the Sogetsu School in Tokyo. He initiated his Zen courses at Loyola partially in response to student unrest in the wake of the Kent State massacre.Wren published very little and did not easily negotiate the tenure process. His Zen among the Magnolias (1999) represents more personal testimony than scholarly argument. He did, however, have the extraordinary ability to stretch his students' imaginations and aspirations beyond the formal limitations of higher education and professional expectations. In this paper I show that, from a philosophical perspective, in Elie Wiesel’s work in general and in Night in particular, the relation between ethics and religion is based on complementarity. In order to achieve this, I have analysed the way in which memory is shown as an invitation to participation in a common set of meanings, values and actions. What I deem most significant is the way in which the memory of the Holocaust is constituted as a medium of (...) action and of communion among humans in an act of mutual responsibility. Through this, the memory of the Holocaust obliges us to assume an ethics of responsibility and of action that rules out the possibility of a contemporary repetition of the events that took place in the death camps. I use Night to show how this narrative reveals several points that are important for understanding certain aspects of the relation between ethics, religion and the memory of the Holocaust. One of these is the understanding of memory as a way to bring man and God together in a relation of mutual communication, beginning with the experience of suffering of dehumanization and of God’s absence from the death camp. Another is that the religious and cultural memory represented by Israel is the main target of extermination as a manifestation of radical evil. A third is that Israel’s suffering has a paradigmatic value, and therefore the memory of the Holocaust becomes a special power that may be used as a tool to diminish the power of evil through the elimination of indifference and the assumption of responsibility. Il s'agit là d'un livre sur la lecture et l'écriture. Son véritable thème est cependant l'impertinence, voire l'impossibilité. A quoi bon, en effet, écrire sur la lecture quand il suffit de lire? Et que peut-on dire de plus sur l'écriture si l'on écrit déjà? Ainsi ce livre ne comportera-t-il, à proprement parler, aucune matière, et ne transmettra-t-il essentiellement qu'un mouvement : celui de la lecture des testes des autres et de l'écriture qu'elle entraînera. Seul le mouvement peut changer une impossibilité (...) en possibilité, voire en nécessité. Ayant compris, dans une vie antérieure de lecteur, l'impossibilité du Tractatus de Wittgenstein comme livre de pensée, on touchera ici à la nécessité qu'il soit écrit. Puis on explorera, avec " Pierre Ménard, auteur, du Quichotte ", une curieuse possibilité, celle que cette nécessité d'écrire soit le fait du lecteur et non pas de l'auteur. Enfin on aboutira, avec Joseph Joubert et Maurice Blanchot, à l'impossibilité d'écrire, c'est-à-dire à la question de la possibilité de la littérature posée enfin avant celle de la philosophie. C'est en effet avec Blanchot que s'ouvrira le passage entre la philosophie et la littérature et que l'engin de l'écriture atteindra sa " vitesse de libération ". This article concerns the ways in which authors from various fields conceptualise the ethical issues arising in the conduct of research. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) we (...) critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

Identity-Relative Paternalism, as defended by Wilkinson, holds that paternalistic intervention is justified to prevent an individual from doing to their future selves (where there are weakened prudential unity relations between the current and future self) what it would be justified to prevent them from doing to others.1 Wilkinson, drawing on the work of Parfit and others, defends the notion of Identity-Relative Paternalism from a series of objections. I argue here, however, that Wilkinson overlooks a significant problem for Identity-Relative Paternalism—namely, that (...) it yields unactionable and self-contradictory results when applied to choices where both options present potential harms to future selves. Stoffregen & Bardy's target article is based on the assumption that our senses' ultimate purpose is to provide us with perfect information about the outside world. We argue that it is often more important that information be available quickly than that it be perfect. Consequently our nervous system processes different aspects of information about our surrounding as separately as possible. The separation is not between the senses, but between separate aspects of our surrounding. This results in inconsistencies between judgments: sometimes (...) because different frames of reference are used. Such inconsistencies are fundamental to the way the information is picked up, however, and hence cannot be avoided with clearer instructions to the subjects. (shrink)

Background In February, 2015, the Supreme Court of Canada struck down the ban on medical assistance in dying. In June, 2016, the federal government passed Bill C-14, permitting MAiD. Current medical students will be the first physician cohort to enter a system permissive of MAiD, and may help to ensure equitable access to care. This study assessed medical student views on MAiD, factors influencing these views, and opportunities for medical education. Methods An exploratory cross-sectional survey was developed and distributed to (...) medical students across all years of a three-year Canadian undergraduate medical program. The investigators administered the survey to participants during academic sessions from November to December, 2015. Analysis of the results included summary descriptive statistics, Pearson’s chi-square test of independence to identify differences between participants by year of study, logistic regression to identify factors that influence students’ stances on MAiD, and Wilcoxon signed rank test to measure changes in student support for MAiD and comfort discussing MAiD. Results There were 405 participants for a response rate of 87%. The majority of students supported the Supreme Court’s decision, 61% would provide the means for a patient to end their life, and 38% would personally administer a lethal medication. Students who were more willing to provide the means for MAiD found medical education/clinical experience and patient autonomy to be important contributors to their stances on MAiD. Those students who were less willing to provide the means for MAiD found religious/spiritual beliefs and teachings, as well as concern about potential negative consequences, to be important contributors to their stances on MAiD. Educational training desired by participants included medicolegal, communication skills, technical skills, and religious. Conclusions Medical students generally supported and would provide the means for MAiD to patients. They also indicated a desire for directed medical education on MAiD. (shrink)

Memory, mother of the Muses by Zeus, has nurtured culture for nearly three millennia while her nemesis, forgetfulness, has been demonized as an agent of destruction. In the modern age, however, memory has grown increasingly burdensome, opening the way for a more positive assessment of forgetfulness. Nietzsche praises animals for an inability to remember that preserves their innocence and happiness, and Freud documents the discontents of a civilization that cannot forget. ;In tracing the recent development of these issues, the dissertation (...) focuses primarily on Walter Benjamin, Hans Blumenberg, and Thomas Pynchon. Benjamin and his anguished "angel of history" show the destructive psychological effects of trying to use human memory as a secular form of redemption. Blumenberg's philosophy of history makes it possible to trace memory's responsibility for redemption to the modern age's inflated notion of the subject. Blumenberg's work also emphasizes the importance of metaphor and narrative in mediating and creating historical understanding, and this aesthetic distance weakens memory's redemptive relation to the past. Pynchon's protagonists, too, find that their desire to make historical meaning fully present is overshadowed by their fear of such presence. By reconciling themselves to a profane aesthetic distance from the past, Blumenberg and Pynchon redeem themselves from the melancholy engendered by an overly ambitious memory. ;Thus the dissertation attempts to recover a more modest and less oppressive memory by understanding it as a way to distance rather than redeem past injustices. This reconception of the function of memory helps establish an equilibrium between the pensive memory of Benjamin's "angel of history" and the innocent oblivion of Nietzsche's animals. ;In addition to the three major figures named in the title, the dissertation devotes sections and excursuses to Friedrich Nietzsche, Sigmund Freud, Ernst Cassirer, Martin Heidegger, Virginia Woolf, Ernst Robert Curtius, Elie Wiesel, Primo Levi, Michel Foucault, and Thomas Kuhn. This paper examines the notion of fouls in sports. In the first part of the paper, we examine some actual distinctions and classifications between different kinds of fouls. In the second part we examine the significance, validity, and justification of these classifications from a normative perspective.The term ‘foul’ evokes negative connotation; some would say—negative normative connotations. Conventional wisdom suggests that typically to commit fouls is, by definition, to go against the rules or principles of the contest. Since sport contests are (...) constitutive activities—this means that to foul is to go against the essence of the contest. In other words, to commit fouls seems not to play the game; it seems unsporting. Consider the following typical example: in a premiership match in 2014 Hull’s forward Nikica Jelavic spun around Company and had a clear path to the goal. Scientists often diverge widely when choosing between research programs. This can seem to be rooted in disagreements about which of several theories, competing to address shared questions or phenomena, is currently the most epistemically or explanatorily valuable—i.e. most successful. But many such cases are actually more directly rooted in differing judgments of pursuit-worthiness, concerning which theory will be best down the line, or which addresses the most significant data or questions. Using case studies from 16th-century astronomy and 20th-century geology and (...) biology, I argue that divergent theory choice is thus often driven by considerations of scientific process, even where direct epistemic or explanatory evaluation of its final products appears more relevant. Broadly following Kuhn’s analysis of theoretical virtues, I suggest that widely shared criteria for pursuit-worthiness function as imprecise, mutually-conflicting values. However, even Kuhn and others sensitive to pragmatic dimensions of theory ‘acceptance’, including the virtue of fruitfulness, still commonly understate the role of pursuit-worthiness—especially by exaggerating the impact of more present-oriented virtues, or failing to stress how ‘competing’ theories excel at addressing different questions or data. This framework clarifies the nature of the choice and competition involved in theory choice, and the role of alternative theoretical virtues. (shrink)

To clarify the proper role of values in science, focusing on controversial expert responses to Covid-19, this article examines the status of (in)convenient hypotheses. Polarizing cases like health experts downplaying mask efficacy to save resources for healthcare workers, or scientists dismissing “accidental lab leak” hypotheses in view of potential xenophobia, plausibly involve modifying evidential standards for (in)convenient claims. Societies could accept that scientists handle (in)convenient claims just like nonscientists, and give experts less political power. Or societies could hold scientists to (...) a higher bar, by expecting them not to modify evidential standards to avoid costs only incidentally tied to error. (shrink)
